Curbeet Terms & Conditions
By accessing our app CURBEET, you are agreeing to be bound by these Terms & Conditions, all applicable laws and regulations, and agreeing that you are responsible for compliance with any applicable local laws. If you do not agree with the Terms & Conditions, you are prohibitedfrom using or accessing CURBEET. The materials contained in CURBEET are protected by applicable copyright and trademark law.
Use License
Permission is granted to temporarily download one copy of CURBEET per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: i. modify or copy the materials; ii. use the materials for any commercial purpose or for any public display (commercial or non-commercial); iii. attempt to decompile or reverse engineer any software contained in CURBEET; iv. remove any copyright or other proprietary notations from the materials; or v. transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by CURBEET at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
Disclaimer
CURBEET aggregates the best available information frompublic and private sources to generate risk analysis, early warning alerts anddisplay of emergency assistance information related to safety, preparedness andresponse from natural hazards.
The materials within CURBEET are provided on an ‘as is’ basis. CURBEET makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property, or other violations of rights.
CURBEET shall take all reasonable steps to ensure the accuracy and timely provision of any forecast information according to the acceptable rules of science and technology. Nevertheless, the user acknowledges the inherent uncertainty in weather, climate and hazard forecasting and accepts that CURBEET makes no guarantee or warranty as to the accuracy of any forecast provided by CURBEET.
Further, CURBEET does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its app, website or otherwise relating to such materials or on any sites linked to CURBEET.
Information based on data collected by CURBEET in thePhilippines shall not be taken as official data. Information broadcasted and distributed by Official Government Agencies (ex: PAGASA, PHIVOLCS, LocalGovernment and more) remains official data. CURBEET shall not be responsible for the private use and reliance of its information.
The emergency services only aims to provide publicly available information to the user such as main emergency hotline of LocalGovernment Offices and other contact information from public and private agencies, CURBEET does not warrant or make any representations concerning the service level, accuracy, likely results of the response of the contact information. The response of these agencies is out of CURBEET’s control.
SMS Notifications (Local Early Warning Alerts)
You will be subscribed to receive SMS alerts from CURBEET if you activate the Bulk SMS feature. This extends the in-app notifications thruSMS that contains the local early warning alerts for which you can input your own phone number and have the option to input other phone numbers (recipients).If you input other phone numbers (recipients), you agree that you have the full permission of the recipients to receive SMS alerts. The Message frequency depends upon your alert subscription. CURBEET SMS credits rates apply. SMS messaging may not be available in other areas. Not all mobile devices or handsets may be supported. CURBEET and the mobile carriers are not liable for delayed or undelivered messages.
If you or your recipients receive SMS alerts from CURBEET without your permission, please report quickly by sending an email to curbeet@komunidad.co.

PHONE NUMBERS. The SOS feature will send SMS containing your location data to your recipients. If you input phone numbers (recipients), you agree that you have the full permission of the recipients to receive SOS alerts. CURBEET SMS credits rates apply. SMS messaging may not be available in other areas. Not all mobile devices or handsets may be supported. CURBEET and the mobile carriers are not liable for delayed or undelivered messages.

GPS Location and Chat Messages
GEOLOCATION. When you use the Activity Monitor and create aTracking Session, we collect all participants unique user identifier and location through GPS, WiFi, or wireless network triangulation in order to obtain the location for the purposes of providing the Tracking service.
As a host of the Tracking Session, you will need to add other users (participants), you will need to invite and ask permission for other users to join your Tracking Session.
We maintain location information only so long as isreasonable to provide the Service and then delete location data tied to yourpersonal information. We may maintain de-identified location data for a longerperiod of time in order to analyze aggregate trends and metrics. We may alsoshare location information with third parties for advertising, research, andanalytic purposes. If you want to opt-out of the collection of your locationdata, please adjust your settings in your mobile device to limit the app’saccess to your location data.
MESSAGES AND USER CONTENT. We collect information when youmessage participants of your Tracking Session through the use of the chatfunction. We may also retain any messages only up to 24 hours only.
Audio, Video and Chat
AUDIO, VIDEO AND CHAT USER CONTENT. We collect audio and video content including chat when you use HIVE or ACTIVITY MONITOR function. We may also retain any content only up to 24 hours only. Audio and video content including chat, or other materials that you or your group generate or provide in connection with CURBEET, together with any resulting transcripts, recordings, outputs, visual displays, or other content, may only be accessed, processed or used for the following reasons: (i)consistent with this Agreement and as required to perform our obligations and provide the Services; (ii) in accordance with our Privacy Statement; (iii) as authorized or instructed by you; (iv) as required by Law; or (v) for legal, safety or security purposes.
NO AI MODELLING AND TRAINING. We do not use any of your audio, video, chat or other content to train CURBEET or third-party artificial intelligence models.
OBLIGATIONS OVERY USER CONTENT. CURBEET will maintain reasonable physical and technical safeguards to prevent the unauthorized disclosure of or access to user content. CURBEET will notify you if it becomes aware of an unauthorized disclosure or unauthorized access to user content. CURBEETwill ensure that any sharing user content with an authorized third party will be in compliance with applicable Law.
USER RESPONSIBILITIES. You are solely responsible forcompliance with all Laws and regulations pertaining to the user content, including Laws requiring you to obtain the consent of a third party to use, license or generate user content and to provide appropriate notices of third party rights. CURBEET may delete any user content, at any time without notice to you if CURBEET becomes aware that it violates any provision of thisAgreement or any applicable Laws. You retain all ownership rights in your user content subject to any license or other rights granted herein.
Subscription and Cancellation Terms
SERIOUS PLAN Renewal: Your subscription will automatically renew monthly unless you cancel before the renewal date. If canceled, the downgrade to the free version will take effect on the day following the end of the current subscription period.
IN-APP PURCHASES: Any in-app purchases will seamlessly transfer to the new subscription plan upon activation.
CANCELLATION: You have the option to cancel your subscription at any time. Refunds or credits will not be issued for partial subscription periods.
Limitations
In no event shall CURBEET or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use CURBEET, even if CURBEET or a CURBEET authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Accuracy of Materials
The materials appearing in CURBEET could include technical, typographical, or photographic errors. CURBEET does not warrant that any of the materials on CURBEET are accurate, complete, or current. CURBEET may make changes to the materials contained in CURBEET at any time without notice.However, CURBEET does not make any commitment to update the materials.
Links
CURBEET has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by CURBEET of the site. Use of any such linked website is at the user’s own risk.
Modifications
CURBEET may revise these terms of service for its app at anytime without notice. By using CURBEET you are agreeing to be bound by the then current version of these terms of service.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Philippines and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
Changes to This Policy
At our discretion, we may change our Terms Conditions toreflect current acceptable practices. We will take reasonable steps to letusers know about changes via our app. Your continued use of our app after anychanges to this policy will be regarded as acceptance of our Terms Conditions.If we make a significant change to this Terms & Conditions, we will ask youto re-consent to the amended privacy policy.
